Terms of purchase
DEFINITIONS
Except as otherwise and expressly provided for in other specific provisions, the terms listed below have in these conditions of purchase the meaning that is attributed to them in the following definitions:
– WORKING DAYS means the days in which our offices are open for normal activities (generally every day from 9 to 13.00 and from 15.00 to 17.30 excluding Saturdays, Sundays and public holidays).
– CAUSES OF FORCE MAJEURE are situations resulting (directly or indirectly) from any strikes, lockouts, fires, floods, proven impossibility to procure products, materials or services, breakdowns, delays by suppliers or couriers, laws or government regulations or any other cause or event that is beyond our control. The above is provided as an example only. There are other events that may be force majeure.
In any case, the customer will be promptly informed by e-mail or telephone notice.
OBJECT
These purchase conditions concern the purchase of typical and complementary products carried out remotely via computer network on the site “www.tenutaferrero.it” belonging to Ferrero Nicola with headquarters in Serracapriola (FG), Via Casale Defensa snc. These purchases are reserved for direct user customers. Each purchase transaction will be governed by the provisions of Legislative Decree 185/99 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Legislative Decree n. 196/03.
ORDER ACCEPTANCE
By sending the order online, the Customer sends Tenuta Ferrero a proposal to purchase the product and/or products included in the cart. When the Customer places an order online for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these purchase conditions. Tenuta Ferrero will send the Customer an order acceptance and confirmation e-mail containing the number, date and total amount of the order and the method of delivery of the product. If, for any reason, Tenuta Ferrero is unable to process the Customer’s order (for one of the cases indicated below), it will immediately notify the Customer via the website itself or by telephone.
In particular, Tenuta Ferrero will reverse the order:
– if in case of purchase of a product present in the warehouse but in quantities lower than the order placed by the customer, this is a product no longer in production;
– if the Customer’s credit card issuer does not confirm the payment.
However, Tenuta Ferrero reserves the right not to accept the order, also in this case communicating it to the customer.
CUSTOMER COMMITMENTS
These general conditions of purchase must be examined online by customers before sending their orders. The forwarding of the order therefore implies their total knowledge and their full acceptance. The Customer undertakes and obliges, once the online purchase procedure has been completed, to print and keep these general conditions of sale, which have already been viewed and accepted during the purchase process, in order to fully satisfy the condition to articles 3 and 4 of Legislative Decree n. 185/1999.
PRICES
All prices on the site include VAT. The prices shown on this site are the sales prices currently in force.
PAYMENTS
The payment of the purchased products and the relative shipping costs must be made by the customer when placing the order by using one of the credit cards available and indicated online, by bank transfer (in this case the The order will be processed upon receipt of the CRO number or upon crediting the sum by the bank).
DELIVERIES
In case of acceptance of the order, it is specified that:
– shipments will be made on the following working day, except in cases where it is specified that the ordered goods are not present in the warehouse, therefore waiting for the same to be produced and the stock in the warehouse to be restored;
– if the order was placed on a non-working day, the goods will in any case be shipped on the first following working day.
Exceptions may occur in the event of CAUSE OF FORCE MAJEURE.
The goods will be delivered via a home courier service. Shipping means the delivery of the goods to the courier. The delivery times described during the purchase process on the site depend on the shipping method used, according to the weight and dimensions of the items purchased. The courier will deliver the goods only against a signature confirming receipt of the goods.
In the event that the goods, sent by courier, do not arrive within the established deadline, the Customer must contact Tenuta Ferrero at the number indicated on this site. In the event that the goods have not been delivered due to the impossibility of the Customer to receive them, the latter must first contact the courier using the references that are left by the courier himself for cases of non-receipt of the goods and, in the event that this operation is not possible, contact our warehouse via the contacts published on www.tenutaferrero.it.
LIABILITY FOR DELAYED DELIVERY
If the shipment of the goods cannot take place within the agreed times or the appointed courier fails to deliver the goods within the set delivery times, Tenuta Ferrero will contact the Customer as soon as possible and, based on the latter’s needs, will to establish another delivery term.
In the event that it is not possible to reach an agreement in this sense, Tenuta Ferrero will reimburse the Customer for the entire amount paid.
IMPORTANT:
In the event of a return, the customer must report the quantities and qualities returned on the courier slip.
As the only burden, and if the error is not due to a fact attributable to Tenuta Ferrero, the Customer will have to bear the costs of returning the goods. The goods must be returned intact and in the original packaging, complete with all its parts and without having suffered any damage. Upon its arrival at the warehouse, the goods will be examined and, in the presence of damage or tampering, the refund cannot be exercised. Tenuta Ferrero will refund the customer the full amount already paid within the terms of the law. The refund will be made by re-crediting the amount due to the credit card used by the Customer for the purchase subject to refund, or to the bank or postal current account indicated by the Customer. It will be the Customer’s responsibility to promptly provide Tenuta Ferrero with any information necessary for a correct and prompt refund procedure.
COMPLAINTS
Any complaints must be addressed directly to Tenuta Ferrero, which undertakes to respond to complaints within two working days.
JURISDICTION
For any dispute, the competent court is that of Foggia, branch of San Severo (FG).

Return of goods
If you are not satisfied with the purchase, contact us directly (within 10 days of receiving the goods), indicating your data and the purchase reference at info@tenutaferrero.it, or call us at one of our telephone numbers, indicating why you are not satisfied with what you received. This will allow us to improve the quality and service of our company.
We also ask you to carefully pack the product, in order to protect it from possible shocks during the return shipment. We inform you that the shipping costs will be at your expense.
Upon receipt of the goods, we will replace them, or, based on your request, refund them within 24 hours.
